If appointed as Personal Welfare deputy, you can make decisions about medical treatment and how that person is looked after. However, the Court are reluctant to grant these applications as if there is no Power of Attorney in place then it is up to professionals such as social workers and health care professionals to usually make these decisions. This type of application is only successful if it is in relation to a specific decision, for example, what treatment an individual should receive or where they should live.
If appointed as a Property Deputy or as Financial Affairs Deputy, you will be able to make decisions about someone’s finances such as dealing with their bank account and property.
To become a Deputy, you would need to make a COP1 application to the Court of Protection. If the application is in relation to property and affairs, then you will need to use COP1A and annex, if it is in relation to Health and welfare, then you would need to use COP1B and annex. For both applications you will also need a COP3 which is an assessment of the individual’s capacity as well as a COP4 (Deputy’s Declarant).
